The Administrative Appeals Tribunal (AAT) is an independent body that conducts merit reviews of decisions made by the Department of Home Affairs. In its review process, the AAT reconsiders the facts, law, and policy of the original decision, and can assess new information that was not available to the original decision-maker.

Options Available
If you have received a visa refusal, you have two main options:

Lodge Another Visa Application

If your offshore visa was refused, you may not have review rights with the AAT (this requires further assessment). In such cases, lodging a new application with additional supporting evidence and legal submissions addressing the reasons for refusal may be necessary.

Appeal to the Administrative Appeals Tribunal

If your visa refusal or cancellation falls within the AAT’s jurisdiction, you can appeal the decision. The AAT has the authority to review decisions made under the Migration Act 1958, including:

Visa refusals or cancellations
Visa sponsorship and nomination refusals or cancellations
And other matters within its scope
